Processing of personal data

1. Introduction

Starting May 25, 2018, the European Regulation 617/2016 on the processing of personal data (GDPR) has entered into operation.

2. The data operator and the Person responsible for the protection of personal data

Fida Solutions, based in Baia Mare, Gheorghe Pop de Băsești street, no. 11, Maramureș County is the operator of personal data, according to the legislation on the protection of European and national personal data and other legal provisions.

3. The data we process

The company processes the personal data you provide to us when you use our applications or contact us by any means of communication:

• name and surname,
• Email address,
• Vehicle’s license plates,

For billing, in case of payment by card, the following data are collected:

• Legal entity:
• company name
• Vat number (CUI)
• postal address.
• Individual
• first and last name
• PIN (CNP)
• postal address.

Geolocation

The geographical location of the user is determined in a discontinuous manner in the following cases:

• at the specific request of the user;
• automatically: when the user has given his agreement within the application and allows to take over the location;

By using the service, servers record and collect through secure systems certain information sent by the User's application or browser such as the IP address and the location where the Application is accessed. Also, certain information about the User may be legally collected, as long as he uses the Application, respectively the data mentioned during the registration.

We only process the personal data necessary to ensure the operation of the platform and to ensure a simple and efficient service. The user data is processed for legitimate and limited purposes. These will not be used for marketing or any other purposes outside the operation of the Tulcea Parking application.

Purchases in the Application

We want to inform users that we do not process financial-banking data. This data is only processed by the payment processor for the purpose of transferring funds.

Credit card payments are processed through banking services provided by BT.

4. Android permissions

For the application to run at full potential, the following permissions are required:

• Internet access: allows the application to communicate with the API and the payment processor;
• Network connection view: allows the application to detect network connection;
• Location approximation: allows the application to detect the user's current position;
• Received start / restart device completed: Allows the application to reprogram, if applicable, the notifications used when parking tickets expire.

5. To whom we disclose the data

The user accepts that Fida Solutions SRL will be able to provide his personal data in the following situations:

• The information is provided to the parking operators, the entities that provide the payment solution with which Fida Solutions SRL is in collaborative relationships, based on a confidentiality commitment from them, which guarantees that these data are kept safe and that the personal information provided is made according to the legislation in force;
• The information is provided for the purpose of collecting claims or reporting damages caused by the User or fraudulent attempts;
• The information is provided under a legal obligation or at the request of a governmental, administrative or judicial authority;
• The information is disclosed with the express consent of the User.

For the exercise of these rights, the user can address with a written / electronic request, dated, signed and scanned, at the mentioned address. Fida Solutions SRL will respond to the User's request and will communicate the measures adopted and / or the information requested in the shortest time, depending on the complexity of the request.

6. How long do we keep the data

We keep your personal data as long as necessary to fulfill the purposes for which they were collected, in compliance with the internal procedures for data retention.

The data sent through the application is secured to the highest standards and we have taken all measures to protect them, and they are stored on a cloud server located in the EU space.

7. Legal rights

As a customer, the user has the following rights regarding personal data:

• be informed about the processing of his personal data;
• to know the entities that have access to his personal data;
• to correct the inaccurate data, respectively to complete the incomplete data;
• to request the permanent deletion of his data, if the processing was not legal;
• withdraw the consent granted for the collection and processing of his data;
• to file a complaint with the National Supervisory Authority for Personal Data Processing (www.dataprotection.ro);

The user assumes responsibility for the data provided and expresses his consent that his personal data transmitted for registration, as well as his geographical location, will be used by Fida Solutions SRL, a legal person registered in the registry of the processing of personal data on which collects them from Users under Law 50/1991 republished, Order 839/2009.

The information provided by the Users following the registration will be treated as confidential information and will not be made public or communicated to third parties except to the extent necessary to fulfill the obligations assumed by Fida Solutions SRL respectively for internal purposes, to administer and maintain the functionalities of the application and to improve the services offered.

8. Security measures

Fida Solutions will apply in the use of your personal data the technical and organizational measures necessary to ensure their security, protect against accidental or illegal destruction, modification, disclosure or unauthorized access.

9. Updates of the privacy policy

We reserve the right to change our privacy practices and to make changes to this privacy policy at any time and we will publish the new version here, and this will replace the current version. We will manage your personal data in accordance with the privacy policy under which they were collected, unless you consent to us otherwise managing them.
