Processing of personal data

1. Introduction

Starting with May 25th, 2018, the European Regulation 617/2016 on processing personal data (GDPR) was introduced.

2. The data operator and responsible for personal data protection

Fida Solutions, based in Baia Mare, Gheorghe Pop de Basesti street, no. 11, Maramures County is the personal data operator, according to the European and national legislation on personal data protection and other legal provisions.

3. The data we process

Our company processes the personal data you provide us when you use our app or contact us by any means of communication. The following data is collected:

name and surname,
email address,
vehicle's license plate,
phone number (indirectly received from NETOPIA, our payment processor, when you make an SMS payment)

In case of a card payment, the following data is collected for billing purposes:

For Legal entity:
- company name
- VAT number (CUI)
- postal address.
For Individual:
- first and last name
- PIN (CNP)
- postal address.

Geolocation

The geographical location of a user is determined in a discontinuous manner, in the following cases:

at request by the user;
automatically: when a user has given the permission within the app and allows the app to get his location;

When the user pays to park, creating a new ticket, the location determined automatically or by request will be retrieved and stored on the server.

By using this service, servers record and collect through secure systems certain information sent by the user's application or browser such as the IP address and the location where the app is accessed. Also, certain information about the user may be legally collected, as long as the app is used, respectively the data mentioned during the registration process.
We only process the personal data necessary to ensure the operation of the platform and to ensure a simple and efficient service. The user data is processed for legitimate and limited purposes. These will not be used for marketing or any other purposes outside the operation of the Suceava Parking application.

In app purchases

We want to inform users that we do not process financial-banking data. This data is only processed by the payment processor for the purpose of transferring funds.

MobilPay is the payment service provided by the payment processor NETOPIA, which allows users to make payments online by card or offline via SMS.

4. Android/iOS permissions

For the application to run at its full potential, the following permissions are required:

Internet access: allows the app to communicate with the API and payment processor;

Network connection state: allows the app to detect if there is network connection;

Location approximation: allows the app to detect user's current location;

Send text messages (SMS): allows the app to send a preformatted SMS to NETOPIA;

Received device boot completed: allows the app to recreate, if necessary, the notifications used to signal that a parking ticket expired or is about to expire.

5. To whom we disclose the data

The user accepts that Fida Solutions SRL will be able to provide his personal data in the following situations:

The information is provided to the parking operators, the entities that provide the payment solution with which Fida Solutions SRL collaborates, based on a confidentiality commitment from them, which guarantees that these data are kept safe and that the personal information provided is used according to the current legislation;
The information is provided for the purpose of collecting claims or reporting damages caused by the User or fraudulent attempts;
The information is provided under a legal obligation or at the request of a governmental, administrative or judicial authority;
The information is disclosed with the express consent of the User

To exercise these rights, the user can address with a written / electronic request, dated, signed and scanned, at the mentioned address. Fida Solutions SRL will respond to User's request and will communicate the measures adopted and / or the information requested in the shortest time, depending on the complexity of the request.

6. How long do we keep the data

We keep your personal data as long as necessary to fulfill the purposes for which the data was collected, in compliance with the internal procedures for data retention.

The data sent through the app is secured to the highest standards, we have taken all measures to protect them and they are stored on a cloud server located in the EU space.

7. Drepturile legale

As a customer, the user has the following rights regarding personal data:

to be informed about the processing of his personal data;
to know the entities that have access to his personal data;
to correct the inaccurate data, respectively to complete the incomplete data;
to request the permanent deletion of his data, if the processing was not legal;
withdraw the consent granted for the collection and processing of his data;
to file a complaint with the National Supervisory Authority for Personal Data Processing (www.dataprotection.ro);

The user assumes responsibility for the data provided and expresses his consent that his personal data transmitted for registration, as well as his geographical location, will be used by Fida Solutions SRL, a legal entity registered in the registry of personal data processing on which collects them from Users under Law 50/1991 republished, Order 839/2009.

The information provided by the Users following the registration will be treated as confidential information and will not be made public or communicated to third parties except to the extent necessary to fulfill the obligations assumed by Fida Solutions SRL respectively for internal purposes, to administer and maintain the functionalities of the app and to improve the services offered.

8. Security measures

Fida Solutions will apply technical and organizational measures necessary to ensure the security of your personal data, will protect against accidental or illegal destruction, modification, disclosure or unauthorized access.

9. Privacy policy updates

We reserve the right to change our privacy practices and the right to make changes to this privacy policy at any time. We will publish the new version here and this will replace the current version. We will manage your personal data in accordance with the privacy policy under which they were collected, unless you consent us to manage them in other way.
